Are tiny homes legal in Florida?
What Florida law actually says about tiny homes in 2026, which bills died, and what each Tampa Bay county allows, with links to the code.
Yes, but how depends on the house. A tiny house on a permanent foundation is legal statewide as a building type: Florida's Building Code has included a tiny house appendix since 2020. A tiny house on wheels is legally an RV or park trailer, meant for temporary or seasonal use. Where either one can go is decided county by county and city by city, and as of October 2026 no state law forces local governments to allow them.

The short answer
Tiny homes are legal in Florida. What isn't settled statewide is where they can go. That's local.
- On a foundation: Florida's Building Code has included a tiny house appendix since 2020, so a permitted tiny house is a recognized building type everywhere in the state.
- On wheels: it's a travel trailer or park trailer under state law. Florida defines a park trailer as "designed to provide seasonal or temporary living quarters."
- Placement: every county and city decides through zoning, including whether to allow accessory dwelling units (ADUs).
As of October 2026, no Florida law requires local governments to allow tiny homes or ADUs. Bills to expand them died in 2024 and 2026.
What state law says
The Florida Building Code: tiny houses on foundations
A 2024 Florida House staff analysis states that the 2020 Florida Building Code added Appendix Q, setting statewide standards for tiny houses on permanent foundations. It defines a tiny house as a dwelling of 400 square feet or less in floor area, excluding lofts.
The appendix (based on the International Residential Code's tiny house appendix) relaxes the rules that make small homes hard to build:
- Ceiling height at least 6 ft 8 in in habitable rooms and hallways, 6 ft 4 in in bathrooms and kitchens
- Lofts at least 35 square feet and 5 feet in every horizontal direction
- Loft access by stairs, ship ladders or ladders, with specific dimensions
- Loft roof windows count as emergency exits if the sill is no more than 44 inches above the loft floor

Florida Statutes: tiny houses on wheels
Florida Statute 320.01 sorts towable living units into categories:
- Travel trailer: body width no more than 8.5 feet, body length no more than 40 feet, "primarily designed and constructed to provide temporary living quarters for recreational, camping, or travel use."
- Park trailer: body width no more than 14 feet, built on a single chassis, "designed to provide seasonal or temporary living quarters when connected to utilities," up to 400 square feet when built to ANSI A119.5.
On the road, Florida caps vehicles at 102 inches wide and 13 feet 6 inches tall (Fla. Stat. 316.515). See the tiny house trailer guide.
The bills that died
| Bill | What it would have done | What happened |
|---|---|---|
| CS/HB 557 (2024) "Movable Tiny Homes" | Allowed movable tiny homes built to the Florida Building Code to be used year-round; capped at 14 ft wide and 500 sq ft | Died in House Commerce Committee, March 8, 2024 |
| SB 48 (2026) | Required every jurisdiction to allow at least one ADU on single-family lots; barred extra parking and owner-occupancy mandates | Passed Senate; died in the House on the last day of session |
| CS/HB 313 (2026) | Required local ADU ordinances; removed the affidavit requirement | Died in committee, March 13, 2026 |
The 2024 staff analysis explains the problem the first bill tried to solve: a movable tiny home can register as a park trailer, but that status is "limited to seasonal use."
What did pass: a tiny home study
The 2026 housing bill that did become law, CS/CS/HB 1389 (Chapter 2026-179), doesn't touch the ADU statute. It does direct OPPAGA, the Legislature's research office, to "evaluate the potential of tiny homes in meeting the need for affordable housing in this state," consulting the Florida Housing Finance Corporation and the Shimberg Center for Housing Studies. The report is due December 31, 2027. Expect tiny home bills to come back after it lands.
Florida's ADU statute
Florida Statute 163.31771 says a local government "may adopt an ordinance to allow accessory dwelling units in any area zoned for single-family residential use." May, not must. The statute frames ADUs around affordable rentals, and it requires a permit application under such an ordinance to include an affidavit that the unit will be rented at an affordable rate. Its history note shows the last amendment was in 2020.
In practice, each city and county writes its own ADU rules. Tampa Bay's are compared in Tampa Bay ADU rules.
Installation and anchoring
Florida Statute 320.8325 makes the owner responsible for installing a mobile home, manufactured home or park trailer to state rules, on a foundation that resists "wind, flood, flotation, overturning, sliding, and lateral movement." It applies to park trailers used as a dwelling and kept in one spot for more than 45 days. Windstorm insurers may only cover a unit installed to those rules.
The state's anchoring rule (15C-1.0104) sets anchor holding power at 4,000 lb working load and 6,000 lb ultimate for homes built after July 13, 1994, and requires new park trailers built after January 2, 1995 to have at least three factory-installed vertical tie points. Details in tiny homes and hurricanes.
Building it yourself
Florida's owner-builder exemption (Fla. Stat. 489.103(7)) lets you act as your own contractor on a one- or two-family residence for your own use. You must personally sign the permit application, directly supervise all work not done by licensed contractors, and not sell or lease the house within a year of completion (doing so creates a presumption you built it for sale). If you install solar under the statute's owner-builder solar provision, a licensed electrical contractor must wire the panels.
Water and waste
- Rainwater: UF/IFAS says stored rainwater is not public water, so watering restrictions don't apply. It also says don't drink it and don't connect barrels or cisterns to in-home plumbing.
- Composting and incinerating toilets: Florida's onsite sewage rule (62-6.009) allows them if they meet NSF/ANSI 41 or NSF Protocol P157. You still need a system for graywater. For residences using them for all toilet waste, the drainfield can be 25% smaller.

Try itTampa Bay counties: what we could verify
This table covers unincorporated areas only. Cities (Tampa, St. Petersburg, Clearwater and others) have their own rules. Where we couldn't open and read the current county rule, we say so. Call before you buy.
| County | ADUs / tiny homes: what we verified | Status | Who to call |
|---|---|---|---|
| Hillsborough | ADU rules are in its Land Development Code. We could not open the current code text, so we're not quoting size or setback numbers. | Call to confirm | Zoning counselors, (813) 272-5600, option 3 |
| Pinellas | Sept 2024 update: ADU max raised from 750 to 1,000 sq ft (750 sq ft in the Coastal Storm Area and flood hazard areas); detached ADUs can't be taller than the main home; ADUs over 750 sq ft need one off-street space; owner occupancy required unless both units are kept affordable; ADU review fees waived. Also allows cottage-style or tiny-home rental developments on one lot. | Verified on county page | Building Services, (727) 464-3888 |
| Pasco | New ADU ordinance reported December 2025: ADUs allowed on property zoned for single-family homes, including a stand-alone tiny house, on a permanent foundation, with size and height limits. We could not read the ordinance itself. | Call to confirm numbers | Building Construction Services, (727) 847-8126 |
| Manatee | ADUs governed by Ordinance 25-08; the owner must occupy either the main house or the ADU "in perpetuity," and a notice to buyers is recorded. We could not verify the size cap. | Call to confirm size, setbacks | Planning, Development and Zoning, (941) 748-4501 x6894 |
| Sarasota | County zoning is in its Unified Development Code. We could not verify current ADU rules on a county page. | Call to confirm | zoning@scgov.net or (941) 861-5000 |
| Polk | Land Development Code is on Municode; the county page does not address ADUs or tiny homes. | Call to confirm | Land Development, (863) 534-6084, or the county's Planner-on-Call |

Tampa, St. Pete and Clearwater
Inside city limits, the city's rules apply, not the county's. The short version for the three biggest cities (full tables in Tampa Bay ADU rules):
- St. Petersburg: ADUs up to 800 sq ft or 67% of the existing home, whichever is less, on eligible lots; the main house does not have to be owner-occupied (City of St. Petersburg, checked October 2026).
- Tampa: ADUs only in certain neighborhoods, and an owner must live on the property. A city release dated August 2026 says 2024 changes expanded the eligible area to include Sulphur Springs, Temple Crest, Wellswood and parts of Riverside Heights, and lets the owner live in either the main home or the ADU (City of Tampa, checked October 2026).
- Clearwater: ADUs up to 750 sq ft or 50% of the main house, whichever is less, with the owner living in one of the two units (City of Clearwater, checked October 2026).
In all three, an ADU is a permitted building. A tiny house on wheels parked in a backyard is not an ADU. For wheels, see where to park a tiny house in Tampa Bay.
Tiny home communities near Tampa
A few communities around the bay are set up for full-time tiny living. Two examples, from their own websites (checked October 2026):
- Circle Pond Tiny Home Community in Ruskin, south Hillsborough County, lists 12 spaces for monthly or yearly rent, with lot space "starting at $625 per month" including water, sewer, garbage, lawn care and electricity. Homes must be "certified safe" and use an instant hot water system (Circle Pond).
- ESCAPE Tampa Bay Village in Thonotosassa sells units built for its own lots and says you can't bring your own RV or mobile home; rental agreements there run 9 to 12 months (ESCAPE Tampa Bay Village).
Rents, openings and rules change, so call before you count on a spot. More options and costs are in where to park a tiny house and tiny house cost.
Hurricanes change the math
Tampa Bay is hurricane country, and tiny homes on wheels are treated like mobile homes when storms come. Pinellas County's evacuation page says residents of mobile and manufactured homes "must always evacuate because of the risk from wind." Hillsborough County says all manufactured and mobile homes are always included in evacuation Zone A, even if they are inland (Hillsborough County, May 2026, checked October 2026). Plan your tie-downs, insurance and evacuation before you plan your kitchen. Read tiny homes and hurricanes.
What to do next
- Decide wheels or foundation (tiny house on wheels vs foundation).
- Call the zoning office for your parcel and get the answer in writing.
- Price the whole project, not just the house (tiny house cost).
- Line up financing that allows how you'll live in it (tiny house financing).
Questions people ask
Can I live in a tiny house full time in Florida?
Yes, if it's a permitted dwelling on a foundation, or if it's on wheels and placed somewhere local zoning allows full-time RV occupancy, such as some RV parks and tiny home communities. Florida's definition of a park trailer calls it seasonal or temporary living quarters, and a 2024 bill to allow year-round movable tiny homes died in committee.
Did Florida pass a law requiring cities to allow ADUs?
No. In the 2026 session, SB 48 passed the Senate and HB 313 was filed in the House to require local governments to allow ADUs, but both died. The housing bill that did pass, HB 1389 (Chapter 2026-179), left the ADU statute alone. Florida's ADU law (s. 163.31771) still says local governments may allow ADUs, not must.
What is the minimum house size in Florida?
There is no single statewide minimum. The Florida Building Code's tiny house appendix covers dwellings of 400 square feet or less, excluding lofts, so the building code itself allows very small homes. Minimum house sizes, where they exist, come from local zoning. Ask your county or city zoning office about your parcel.
Is rainwater harvesting legal in Florida?
Yes, for non-potable uses. UF/IFAS says stored rainwater is not public water, so watering restrictions don't apply, but it says not to drink it and not to connect a rain barrel or cistern to household plumbing. Check with your local building department before connecting pumps or irrigation to anything tied to your potable supply.
Are composting toilets legal in Florida?
Florida's onsite sewage rule (62-6.009) allows waterless, incinerating and composting toilets that meet NSF/ANSI 41 or NSF Protocol P157. You still need a system for graywater and other wastewater. For residences using these toilets for all toilet waste, the required drainfield area can be reduced by 25%.
Is Florida studying tiny homes?
Yes. Chapter 2026-179 (HB 1389) directs the Office of Program Policy Analysis and Government Accountability (OPPAGA) to evaluate the potential of tiny homes to meet Florida's affordable housing need, consulting the Florida Housing Finance Corporation and the Shimberg Center. The report is due by December 31, 2027.
Can I live in a tiny house in Tampa or St. Petersburg?
Yes, in the right place. Inside Tampa and St. Petersburg, a permitted tiny house on a foundation can be a backyard ADU on an eligible lot, within the city's size cap. A tiny house on wheels is treated as an RV, so it belongs in an RV park or tiny home community that allows full-time stays. Check your parcel with the city before you buy.
Are there tiny home communities near Tampa?
Yes. Circle Pond Tiny Home Community in Ruskin, south Hillsborough County, lists lot space starting at $625 a month including water, sewer, garbage, lawn care and electricity, as of October 2026. ESCAPE Tampa Bay Village in Thonotosassa sells its own units and doesn't accept outside RVs or mobile homes. Call any community for current openings and rules.
